Limitation of Liability

Under no circumstances will New System Technologies (NST) be liable for any losses or damages whatsoever, whether in contract or otherwise, from the use of the materials on the website. New System Technologies will not be liable for any loss be it indirect, incidental, or consequential damages.

New System Technologies includes all its owners, subsidiaries, branches, divisions, successors, parent companies and their employees, partners, agents, and representatives as well as any third-party providers or sources of material. While New System Technologies takes all the necessary precautions to safeguard the content documents, it will not be held liable for the loss of data due to power failure, computer viruses, hardware/software failure, natural disasters, or any other unforeseen matters beyond our control. You as the client will be responsible for creating archival copies of your data. In no event will New System Technologies be responsible for any loss, corruption, or alteration of data.

New System Technologies is only responsible for developing software, website and mobile applications as per our service definitions. All views and thoughts expressed in the website are solely of the companies and individuals using the service.

Governing Law

These terms and conditions are regulated by and to be rendered in accordance with Vermont State law. Any disputes shall be subject to the exclusive jurisdiction of State of Vermont courts.

Replacement and Cancellation Policy

Our policy for replacement and cancellation of a project is very simple. This policy will help to minimize the chances of cancellations. The replacement and the cancellation policy are explained below:

Replacement Policy

• We will replace the content a website after acceptance from the client but subsequent work and feature requests outside the scope of the agreed upon work will incur addition charges.
• We will ensure that content provided us will be implemented in the Web, app or software product. Content and features will be replaced only if we implemented them wrong. Client will be responsible for ensuring the accuracy of provided content and NST will not be responsible for spelling mistakes and other accuracy of statement that is provided by the Client.

Cancellation Policy

• Cancellation must be made by emailing us at info@newsystemtechnologies.com
• Cancellation after 5% of work done will be compensated for the losses.
• The cancellation fee will be calculated based on amount of work done on the project.

Refund after Cancellation

• Cancellation fees will be deducted from the refund amount.
• Refund is not possible if any one of the following conditions are met:
  • Refund exceeds payment.
  • Cancellation is after 7 days of placing the order
• In such cases, this amount will be adjusted against future orders.

Quotation

It is understood that once you have accepted our shared quotation over e-mail, it is a formal order. You are then liable to make the payment for the order even if you disagree with the pricing at a later stage.

E-mail Address

By sharing your e-mail details with us, you give us the permission to send you regular updates about our services. If you wish to not receive any updates, you can ask us specifically not to send e-mails to you.

Delivery of Files

We always deliver the projects within the deadline promised to you. In case you do not receive your application, please contact us immediately.

Your Intellectual Property Rights

New System Technologies does not make any claim on work submitted to us for development. You declare that you have obtained all necessary third party rights, including copyrights, business licence, etc. You agree to not use the services for infringing, threatening, harassing or sexually exploiting content.

Notification of Changes

New System Technologies reserves the right to modify these Terms of Service at any time with or without notifying you. The changes will only affect your use of the services from the effective date of the change unless we clearly express otherwise.

Website

This website is owned and operated by New System Technologies and is protected by copyright and other intellectual property laws. You will not copy, reproduce, transmit or distribute in any way, any material from this site, including code and software. You will not download material from this site for your personal, non-commercial use.

Security

We protect your personal information after you transmit your information to our site. While we strive to protect your personal information, we cannot provide warranty or security of any information you transmit to us via the internet.

Payment

Invoices are created by New System Technologies upon completion of the project but before publishing the live website. Invoices are sent via email; however, the Client may choose to receive hard copy invoices. Accounts that remain unpaid after thirty (30) days from the delivery of the project will be served a service charge which should be paid with the actual amount.

Additional Expenses

Client agrees to pay additional expenses incurred for the completion of the work. Some of the examples are purchase of images, special fonts, plugins etc.
